This document sets out the Terms & Conditions of sale and the Privacy Policy applicable to all orders placed with La Flor de May, an online florist operating in the Jalón Valley, Alicante, Spain. 2. SCOPE OF SERVICES
La Flor de May provides floral arrangements, bouquets, and related products prepared to order. Orders may be collected by the customer or delivered locally within the Jalón Valley and surrounding areas, subject to availability.
All products are perishable goods and are prepared specifically for the customer’s chosen date.
3. PRODUCT INFORMATION AND AVAILABILITY
All floral designs are subject to seasonal availability. Images displayed on websites, social media, or marketing materials are for illustrative purposes only. While every effort is made to match the design, exact flower varieties, colours, and packaging may vary.
Where specific flowers or materials are unavailable, La Flor de May reserves the right to substitute them with alternatives of equal or greater quality and value, maintaining the overall style and colour palette where possible.
4. ORDERING PROCESS
Orders may be placed online or by direct contact. The customer is responsible for ensuring that all order details, including delivery address, contact number, delivery date, and any special instructions, are accurate and complete.
Once an order has been confirmed and payment received, it is considered binding and enters production.
5. PRICES AND PAYMENT
All prices are stated in euros (€). Prices include preparation of the floral arrangement but exclude delivery charges unless otherwise stated.
La Flor de May reserves the right to modify prices at any time; however, confirmed orders will not be affected by subsequent price changes.
Payment must be made in full at the time of ordering. Orders will not be prepared or dispatched without confirmed payment.
6. COLLECTION OF ORDERS
Collection is available by prior arrangement only. Customers will be informed when their order is ready for collection.
Orders must be collected at the agreed time. Due to the perishable nature of flowers, La Flor de May cannot be held responsible for deterioration if an order is collected late or not collected at all. No refunds will be issued for uncollected orders.
7. DELIVERY CONDITIONS
Delivery is available within the Jalón Valley and selected nearby areas. Delivery times provided are estimates and cannot be guaranteed.
If the recipient is not present at the delivery address, La Flor de May may, where reasonable, leave the order in a safe place, with a neighbour, or at the entrance of the property. Responsibility for the flowers transfers to the customer at the point of delivery.
If delivery cannot be completed due to incorrect information or absence of the recipient, re-delivery may incur an additional charge. No refund will be given in such circumstances.
8. RIGHT OF WITHDRAWAL AND CANCELLATIONS
In accordance with Article 103(d) of Royal Legislative Decree 1/2007, the right of withdrawal does not apply to goods that are liable to deteriorate or expire rapidly, including fresh flowers.
Cancellations are only accepted if made at least 48 hours before the scheduled delivery or collection date. Cancellations made after this time are non-refundable.
9. COMPLAINTS AND QUALITY ISSUES
If the customer believes that the delivered product does not meet the agreed standard, they must notify La Flor de May within 24 hours of delivery, providing clear photographic evidence.
Each complaint will be assessed on a case-by-case basis. Where a fault is confirmed, La Flor de May may, at its discretion, offer a partial refund, replacement, or store credit. Natural flower ageing, colour variation, or wilting due to environmental conditions are not considered faults.
10. LIABILITY
La Flor de May’s liability is limited to the value of the order placed. Under no circumstances shall La Flor de May be liable for indirect or consequential damages.
La Flor de May accepts no responsibility for allergic reactions or sensitivities to flowers or plants supplied.
11. FORCE MAJEURE
La Flor de May shall not be liable for failure or delay in the performance of its obligations due to circumstances beyond reasonable control, including but not limited to extreme weather, supplier failure, transport issues, illness, or governmental restrictions.
12. GOVERNING LAW AND JURISDICTION
These Terms & Conditions are governed by Spanish law. Any disputes shall be subject to the jurisdiction of the Spanish courts, without prejudice to consumer rights under applicable legislation.

La Flor de May is committed to protecting personal data and complying with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD).
